MIndian News Agency Sues OpenAI Over Alleged Copyright Infringement

Asian News International (ANI), one of India’s largest news agencies, has filed a lawsuit against the American artificial intelligence company OpenAI, accusing it of unauthorized use and storage of copyrighted content to train its Large Language Models (LLMs).

The case, which was presented before the Delhi High Court on Tuesday, marks a significant legal challenge for OpenAI in India, as debates around artificial intelligence technologies and copyright compliance intensify globally.

According to a report by Bloomberg, ANI is demanding initial damages of 20 million rupees ($236,910). Representing the agency, lawyer Sidhant Kumar argued that OpenAI’s alleged use of ANI’s data contributed to the training of its AI models without proper authorization.

In response, OpenAI’s legal representative, Amit Sibal, countered that the case lacked jurisdiction. He stated that OpenAI does not operate servers or conduct model training in India, adding, “ANI’s content is currently blocked on OpenAI’s platform, which undermines ANI’s claims.”

Sibal also pointed out that OpenAI faces similar lawsuits in other jurisdictions, including 13 cases in the United States and one in Germany. He emphasized, however, that no injunctions have been issued against the company globally.

The Delhi High Court acknowledged the complexities surrounding LLM training and intellectual property rights, emphasizing the need for expert input to address these issues. The court admitted the case and scheduled the next hearing for January 28, 2025.
